Welcome to Hoora!
Hoora is a mobile entertainment platform operated by EASYWIN, a single-shareholder simplified joint-stock company (société par actions simplifiée unipersonnelle – SAS) registered under SIREN number 883336216, whose registered office is located at 7 Boulevard Solidarité, 57070 Metz (France), and formerly at 5 Rue du Pré Chaudron, 57070 Metz (France).

These General Terms of Use (hereinafter referred to as the “GTU”) constitute the agreement entered into between users (hereinafter referred to as “You”) and Hoora with respect to the use of the service described below. We encourage You to read these GTU carefully. You are also invited to review our Privacy Policy and Cookie Management.

Your confirmation of acceptance of these GTU or your use of the service constitutes the conclusion of a contract between You and Hoora.

Article 1 – Services covered by these GTU

These GTU set out the terms and conditions governing access to and use of the service offered by EASYWIN (hereinafter referred to as the “Hoora Service”), available through the Hoora mobile application (hereinafter referred to as the “Application”), which is owned and operated by EASYWIN.

The Hoora Service includes all functionalities made available through the Application. This includes, without limitation, the ability to play various games, participate in activities designed to enhance the gaming experience, add friends, and watch video advertisements in exchange for special rewards, all in accordance with these GTU.

Article 2 – Acceptance of the GTU

Use of the Hoora Service implies Your full and unconditional acceptance of these GTU. If You do not accept these GTU, You must refrain from using the Hoora Service.

Article 3 – Your use of the Hoora Service

3.1 Our service and business model

The Hoora Service provides a mobile entertainment experience allowing access to a wide selection of casual and instant games, playable through the Application. The Hoora Service is accessible free of charge and is primarily funded through the display of advertisements. Certain features and content may be offered as paid options, in particular through an offer entitled Hoora Premium and through optional in-app purchases within the Application.

The Hoora Premium offer may, for example, include:

  • the removal of forced advertisements within the Application;
  • access to games added to favorites without an internet connection;
  • access to exclusive benefits (exclusive rewards).

The features included in the Hoora Premium offer may evolve over time. The up-to-date details of the offer are available directly within the Application.

The Hoora Service may also offer optional in-app purchases, in particular allowing the acquisition of virtual currency usable within the Application. The conditions applicable to these in-app purchases are specified in these GTU and through the relevant distribution platforms.

3.2 Access to the Hoora Service

You may access the Hoora Service by downloading the Application on your mobile device (mobile phone, smartphone, tablet). You must ensure that you are using a device with an operating system or browser compatible with the Hoora Service. Failing this, we cannot guarantee the proper functioning of the Hoora Service. We recommend installing the latest updates of your device’s operating system in order to continue benefiting from all available features.

3.3 Access without account creation and optional profile backup

Access to the Hoora Service does not require the creation of a user account. You may use the Application and access its basic features without prior identification.

In order to enable the portability of your profile, preferences, and progression across multiple devices, Hoora offers an optional profile backup feature. This backup may be carried out in particular via:

  • a third-party account (such as an Apple, Google, or equivalent account);
  • or any other backup method made available within the Application.

Activation of this feature allows your profile to be restored on another compatible device.

If no backup is activated, local data (progression, scores, preferences) may be permanently lost in the event of a device change, deletion of the Application, or reset of the device. EASYWIN shall not be held liable for such loss.

You are responsible for the accuracy of the information provided during the backup process and for protecting access to the backup method used.

When a user activates profile backup, a technical account is associated with this backup in order to enable data portability across multiple devices. This technical account may be deleted at any time in accordance with the procedures described in the Help Center.

3.4 Uninstallation of the Application

Once you uninstall the Application from your mobile device, your account is deactivated. If you wish to reactivate it, you must contact customer support; however, reactivation of the account is not guaranteed.

3.5 Minimum age

The Hoora Service is reserved for users aged 13 years and older.
Minor users declare that they have obtained prior authorization from their legal representative to use the Hoora Service.

3.6 Benefits of the Hoora Service

As a user of the Hoora Service, You may optionally:

  • play various games;
  • participate in different activities designed to enhance your gaming experience, including completing missions, improving your score, and progressing through game levels;
  • add other users as friends;
  • watch video advertisements in order to obtain special rewards;
  • use the settings and features of the Hoora Service made available to You from time to time.

Please consult our Help Center for further information regarding the features of the Hoora Service and how to use them.

The authorization granted to You:

  • is limited to what is expressly permitted under these GTU;
  • is valid solely for You;
  • may not be transferred by You to another person;
  • may be withdrawn for the reasons authorized under these GTU.

Access to certain features of the Hoora Service is reserved for users who have subscribed to the Hoora Premium offer, including in particular:

  • the removal of forced advertisements within the Application;
  • access to games added to favorites without an internet connection;
  • access to exclusive benefits (exclusive rewards).

The detailed conditions of the Hoora Premium offer, including pricing and cancellation terms, are specified below and via the relevant distribution platforms. Please refer to the Hoora Premium Offer Terms and Conditions for further information regarding the exclusive features available to Hoora Premium subscribers.

3.7 In-app purchases and virtual currency

The Hoora Service may offer the optional purchase of digital content and virtual currency, in particular in the form of Hoora coins (“Hoora Coins”), usable exclusively within the Application.

Hoora Coins may be obtained:

  • free of charge, in particular through progression within the Application, participation in games, or the receipt of rewards;
  • or by purchase through packs offered in the Application’s Shop.

Hoora Coins constitute a virtual currency:

  • they have no real-world monetary value;
  • they may not be exchanged for real money nor transferred to third parties;
  • they may only be used within the Hoora Service.

Purchases of Hoora Coins are carried out via the distribution platforms on which the Application is downloaded. EASYWIN does not directly manage payments and shall not be held liable for billing processes, refunds, or disputes related to such purchases, which are governed exclusively by the terms and conditions of the relevant platforms.

Unless otherwise required by law or by a specific policy of the distribution platforms, purchases of virtual currency are final and non-refundable.

3.8 Compliance with usage rules

These rules apply to all users of the Hoora Service. If You wish to use the Hoora Service, You must under no circumstances:

  • use the Hoora Service in any manner that violates applicable laws and regulations;
  • compromise the proper functioning or security of the Hoora Service, including by using any automated means not provided or approved by EASYWIN to extract data from the Hoora Service or the Application;
  • engage in inauthentic commercial behavior on the Hoora Service, such as using spam accounts or impersonating another person;
  • infringe the intellectual property rights of others, including copyrights, trademarks, and other intellectual property rights;
  • use third-party software, bots, hacks, mods, or any other form of illegal manipulation intended to cheat or facilitate cheating within the Hoora Service.

In summary, You agree to use the Hoora Service in accordance with these GTU and any applicable policies.

3.9 Restrictions on username creation

In order to ensure a respectful and secure environment for all users, strict restrictions apply to the creation and modification of usernames on Hoora. Usernames must comply with the following criteria:

  • not refer to a political orientation, an ethnicity, a community, or a religion;
  • not be vulgar or offensive;
  • not contain sexual or pornographic connotations;
  • not refer to illegal drugs or any other entity prohibited by applicable law.

To ensure compliance with these criteria, an automated moderation system has been implemented. Any attempt to create or modify a username containing words related to the subjects listed above will be automatically rejected.

This measure is intended to ensure a pleasant and secure gaming experience for all users. By creating an account or modifying your username, you agree to comply with these rules.

Article 4 – Content and intellectual property

4.1 Access to the Hoora Service

Subject to compliance with these GTU (as well as any other applicable terms and conditions), EASYWIN grants You a limited, non-exclusive, personal, and revocable authorization to access and use the Hoora Service strictly for non-commercial purposes.

This authorization remains valid until it is terminated by You or by EASYWIN in accordance with the conditions set forth in these GTU. You agree not to copy, modify, distribute, sell, rent, lend, assign, sublicense, or transfer all or any part of the Hoora Service.

The Hoora Service is licensed, not sold. EASYWIN and its licensors retain all intellectual property rights relating to the Hoora Service, including after the installation of the Application on your devices.

4.2 Hoora intellectual property rights

The Hoora Service, as well as all of its components (including software, games, interfaces, graphics, animations, sounds, texts, trademarks, logos, domain names, and visual elements), are the exclusive property of EASYWIN or its licensors and are protected by intellectual property laws.

These GTU do not grant You any ownership rights or license to use the Hoora brand elements, except for the limited right of use necessary to access and use the Hoora Service in accordance with these GTU.

4.3 Cheating Detection

In order to preserve the integrity, fairness, and proper functioning of the Hoora Service, EASYWIN may implement mechanisms to detect and prevent fraudulent behavior or conduct that violates these GTU.

In the event of cheating, abusive use, or any attempt to circumvent the rules of the Hoora Service, EASYWIN reserves the right to take any appropriate measure, including the suspension or termination of access to the Hoora Service, in accordance with Article 9 of these GTU.

Where applicable, EASYWIN may cooperate with the competent authorities to ensure compliance with applicable laws and regulations.

Article 5 – Advertising and financing of the Hoora Service

The Hoora Service is accessible free of charge and is funded in particular through the display of advertisements.

These advertisements may take various forms (videos, interstitial ads, integrated formats) and may be provided by third-party partners. Certain advertisements may be personalized based on the user’s preferences, subject to the user’s prior consent, in accordance with applicable regulations and our Cookie Management. Users may manage their preferences regarding personalized advertising at any time through the settings of the Application or their device.

Users who have subscribed to the Hoora Premium offer benefit from the removal of forced advertisements, under the conditions defined in the Hoora Premium Offer Terms and Conditions.

EASYWIN does not exercise control over the content of advertisements displayed by third parties and shall not be held liable for the content, legality, or practices of such advertisers.

Article 6 – Liability and limitations

The Hoora Service is provided “as is” and subject to availability. EASYWIN uses reasonable efforts to ensure the proper functioning of the Hoora Service, without however guaranteeing continuous availability, error-free operation, or the absence of malfunctions. EASYWIN shall not be held liable in particular for:

  • temporary interruptions of the Hoora Service for technical, maintenance, update, or security reasons;
  • loss of data, scores, progress, preferences, or virtual rewards, in particular in the event of deletion of the Application or the absence of profile backup;
  • incompatibility of the Hoora Service with certain devices, operating systems, or software versions;
  • indirect damages, loss of opportunity, financial loss, or immaterial damages resulting from the use of or inability to use the Hoora Service.

Virtual elements, scores, rewards, benefits, or content accessible through the Hoora Service have no real-world monetary value and may not give rise to any financial compensation.

Article 7 – User-generated content

In the course of using the Hoora Service, users may generate content, in particular through their profiles, social interactions, preferences, game performances, or any other functionality made available within the Application.

Users remain the owners of the content they generate. However, by using the Hoora Service, they grant EASYWIN a free, non-exclusive, worldwide license, valid for the duration of the applicable legal protection, allowing EASYWIN to host, store, reproduce, display, and exploit such content exclusively for the purposes of operating, promoting, and improving the Hoora Service.

Users agree not to publish content that is unlawful, misleading, defamatory, violent, or that infringes the rights of third parties.

EASYWIN reserves the right to moderate, restrict access to, or remove any content that does not comply with these GTU, applicable laws and regulations, or that may adversely affect the proper functioning of the Hoora Service, without giving rise to any right to compensation.

Article 8 – Our commitments

8.1 Quality and security of the Hoora Service

EASYWIN undertakes to provide the Hoora Service with reasonable care and diligence, in accordance with generally accepted professional standards. We implement appropriate technical and organizational measures in order to ensure a secure environment for users.

EASYWIN reserves the right to evolve, modify, suspend, or discontinue all or part of the Hoora Service, in particular for technical, security, service improvement, or legal compliance reasons.

8.2 Protection of personal data

EASYWIN undertakes to respect the confidentiality and protection of users’ personal data, in accordance with applicable data protection regulations, in particular the General Data Protection Regulation (GDPR).

Personal data are collected and processed on appropriate legal bases (performance of a contract, consent, legitimate interest), under the conditions set out in our Privacy Policy, which details in particular users’ rights (access, rectification, deletion, objection, restriction, and portability).

Users who have a saved profile may exercise their right to erasure by requesting the deletion of the associated technical account, in accordance with applicable regulations.

Article 9 – Suspension or termination of our relationship

9.1 Your rights

You may terminate your relationship with EASYWIN at any time by ceasing to use the Hoora Service.

When you have activated profile backup, you may also request the deletion of the associated technical account, in accordance with the procedures described in the Help Center.

Deletion of the technical account results in the permanent deletion of the associated data, subject to applicable legal data retention obligations.

9.2 Hoora’s rights

In the event of suspected violation of these GTU, we are authorized to remove all or part of your content, or to restrict your access to all or part of the features of the Hoora Service, acting in a reasonable and objective manner depending on the severity of the alleged violation.

We further reserve the right to temporarily suspend or permanently terminate your account, or to impose limitations on your access to the features of the Platform, if:

  • we reasonably and objectively conclude that You have committed a serious or repeated violation of these GTU;
  • we have objective reasons to reasonably believe that You are about to commit a serious violation of these GTU;
  • we are legally required to do so;
  • such action is reasonably necessary in response to the resolution of a serious technical or security issue.

It is important to note that we record the number of violations of these GTU associated with your account. Repeated violations or a single serious violation may result in a permanent ban of your account.

Article 10 – Profile portability and technical limitations

The profile backup feature is intended to facilitate the portability of the user experience across different compatible devices.
EASYWIN uses reasonable efforts to ensure the proper functioning of this feature, without however being able to guarantee absolute compatibility across all devices, operating systems, or software versions.

EASYWIN shall not be held liable for:

  • malfunctions attributable to third-party services used for backup;
  • data loss resulting from technical limitations specific to devices or third-party platforms;
  • incompatibilities related to outdated versions of the Application or the operating system.

Article 11 – Hoora Premium Offer

The Hoora Premium subscription is offered on an optional basis.
The conditions applicable to the Hoora Premium subscription, including in particular:

  • the included features;
  • pricing;
  • duration;
  • renewal and cancellation terms;
  • billing and refund rules,

are defined exclusively in the Hoora Premium Offer Terms and Conditions.

Payments are made via the distribution platforms through which the Application is downloaded. EASYWIN is not responsible for payment processes managed by such third-party platforms.

Article 12 – About these GTU

From time to time, we may modify these GTU, including any additional terms and conditions of the Hoora Service incorporated herein by reference. In order to inform You of such changes, we will use any reasonable means, such as publishing a revised agreement applicable to the Hoora Service. In the case of material changes, we will endeavor to supplement such notice with an email, an in-service contextual message, or other means.

These modifications shall not affect any dispute arising between You and us prior to the date of publication of the revised GTU or other terms and conditions of the Hoora Service incorporating such modifications, or prior to the date on which You were informed of such modifications.

By continuing to use the Hoora Service after any modification to these GTU, You accept such changes. If You choose not to continue using the Hoora Service following an update to the GTU, You may terminate your account. The effective date indicated at the top of this document reflects the date of the most recent modification of these GTU.

Article 14 – Dispute resolution

These GTU are governed by French law.

In the event of a dispute, our first step will be to attempt to resolve it amicably. If an amicable resolution cannot be reached, You or we may bring the dispute before the French courts.
